EQUIPMENT RENTAL AGREEMENT
North Alabama Newborn Nurse, LLC
Effective Date: Upon checkout and acceptance
1. Parties
This Equipment Rental Agreement (“Agreement”) is entered into between:
North Alabama Newborn Nurse, LLC
(“Provider,” “we,” “us,” or “N.A.N.N.Y.”)
and
The individual completing the rental checkout (“Client,” “you,” or “family”).
By completing checkout and selecting “I agree to the Rental Agreement,” you acknowledge that you have read, understand, and agree to be legally bound by the terms below.
2. Rental Equipment
Provider agrees to rent to Client the equipment selected at checkout (“Equipment”), which may include but is not limited to:
SNOO Smart Bassinet
Baby gear or related equipment
All Equipment remains the sole property of North Alabama Newborn Nurse, LLC at all times. This is a rental agreement only. No ownership rights transfer to Client.
3. Rental Term & Billing
Monthly Rentals
Rental fees are billed monthly beginning on the delivery date.
Monthly rentals automatically renew every 30 days until canceled.
Payment is automatically charged to the card on file.
To avoid being charged for the next billing cycle, Client must notify Provider at least 7 days prior to the next billing date and schedule pickup.
Equipment must be returned within 7 days of cancellation notice to avoid additional charges.
Short-Term Rentals (If Applicable)
If a fixed rental term is selected (weekly or multi-week), rental fees are charged at checkout and are non-refundable once delivery occurs.
4. Fees & Payment Authorization
By completing checkout, Client authorizes Provider to charge the card on file for:
Rental fees
Delivery and pickup fees
Security deposit (if applicable)
Repair or replacement costs due to damage
Unreturned equipment
Excess cleaning fees
Client agrees to maintain valid payment information on file throughout the rental period.
5. Security Deposit
A refundable security deposit may be required at booking.
The security deposit will be refunded within 5–10 business days after:
Equipment is returned
Equipment is inspected
No excessive damage is found
The deposit may be withheld partially or fully if:
Equipment is returned damaged beyond normal wear
Equipment is excessively soiled
Equipment smells of smoke
Equipment is lost or stolen
If repair or replacement costs exceed the deposit amount, Client authorizes Provider to charge the remaining balance up to the full retail replacement value.
6. Use of Equipment
Client agrees:
To use Equipment only according to manufacturer guidelines
Not to alter, modify, or disassemble Equipment
Not to move Equipment to another residence without written notice
To supervise use according to safe sleep guidelines
Client assumes all responsibility for safe use of Equipment.
7. Smoke-Free Policy
Due to the inability to safely remove smoke residue from infant equipment:
If Equipment is returned with evidence of cigarette or marijuana smoke exposure, Client will be responsible for full replacement cost.
8. Delivery & Pickup
Provider will coordinate delivery and pickup scheduling.
If Client is not present at the agreed delivery time:
Equipment will not be left unattended
Delivery fees are non-refundable
Additional delivery fees may apply
Monthly rentals must schedule pickup within 7 days of cancellation notice to avoid additional monthly charges.
9. Cancellation
Prior to Delivery:
If Client cancels before delivery, Provider may issue a refund at its discretion, minus any administrative or scheduling fees.
After Delivery:
Once Equipment has been delivered, rental fees are non-refundable.
10. Damage, Loss, or Theft
Client is responsible for Equipment from time of delivery until return.
If Equipment is:
Lost
Stolen
Destroyed
Damaged beyond repair
Client agrees to pay up to full retail replacement value.
11. Limitation of Liability
To the fullest extent permitted by law, Provider’s maximum liability under this Agreement shall not exceed the total rental fees paid by Client.
Provider is not responsible for:
Injury resulting from misuse
Failure to follow manufacturer guidelines
Third-party handling of Equipment
12. Indemnification
Client agrees to indemnify and hold harmless North Alabama Newborn Nurse, LLC and its contractors from any claims arising from Client’s use or misuse of Equipment.
13. Force Majeure
Provider shall not be liable for delays or failure to perform due to events beyond reasonable control including natural disasters, government action, or transportation disruptions.
14. Governing Law
This Agreement is governed by the laws of the State of Alabama.
15. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding rental of Equipment and supersedes any prior discussions or communications.
Acceptance
By completing checkout and selecting “I agree to the Rental Agreement,” Client confirms understanding and acceptance of these terms.
